1. Acceptance of these terms
By using the AMBIT website (ambitpu.com), the AMBIT Intelligence app, or AMBIT’s text message program, you agree to these Terms & Conditions. If you do not agree, please do not use them.
These terms are between you and AMBIT Polyurethane LLC (“AMBIT,” “we,” “us,” or “our”), a spray foam and insulation supply company with distribution locations in Oklahoma, Texas, Florida and Alabama. They cover:
- The website ambitpu.com and any pages on it
- The AMBIT Intelligence app (web, phone and desktop versions)
- AMBIT’s text message (SMS) program, described in Section 2
Our Privacy Policy explains how we handle your information and is part of these terms.
2. Text message (SMS) program terms
AMBIT sends account and order text messages to customers and team members who opt in. The program is called AMBIT Account Alerts.
What we text you about. Messages are about your account and your orders, for example:
- A request to approve an order placed for your company, with a link to approve it
- Order status updates: order received, credit released, scheduled, ready for pickup, out for delivery, delivered
- Pickup and delivery reminders
- Account notices such as a credit application decision or an expiring sales tax exemption certificate
- One-time verification codes when you sign in or confirm your phone number
We do not send marketing or promotional texts under this program. If we ever offer promotional texts, we will ask for your separate permission first.
How you opt in. You consent to receive texts when you (a) enter your mobile number in the AMBIT Intelligence app and check the box agreeing to receive text messages, (b) text a keyword such as START or YES to AMBIT’s texting number, or (c) give your number to an AMBIT team member and ask to be texted. Consent to receive texts is not a condition of buying anything from AMBIT.
Message frequency. Message frequency varies and depends on your account activity. For example, a single order may generate 2 to 5 messages from placement to delivery.
Message and data rates may apply. Your mobile carrier may charge you for messages you send and receive. Check with your carrier for details about your plan.
How to opt out. Reply STOP to any AMBIT text message at any time. You will receive one final message confirming you have been unsubscribed, and we will not text you again unless you opt in again. You can also turn off texts in the AMBIT Intelligence app under Profile, or email us at [email protected].
How to get help. Reply HELP to any AMBIT text message, email [email protected], or call 817-677-1200.
Supported carriers. Major U.S. carriers are supported, including AT&T, T-Mobile, Verizon and US Cellular, along with most regional carriers. Carriers are not liable for delayed or undelivered messages.
Your responsibilities. You confirm that you are the account holder or authorized user of the mobile number you provide, and that you are 18 or older. If you change or give up your mobile number, tell us right away so we do not text the new owner of that number.
Privacy. We do not sell your mobile number, and we do not share it with third parties for their marketing. See our Privacy Policy for details.
3. Accounts and the AMBIT Intelligence app
The AMBIT Intelligence app is for AMBIT employees and AMBIT’s business customers (insulation contractors and distributors). You must be 18 or older to create an account.
Your account. You are responsible for keeping your login information private and for everything done under your account. AMBIT employees may sign in with their Microsoft work account. Tell us right away at [email protected] if you believe someone else has used your account.
Accurate information. You agree to give us accurate contact, company and shipping information and to keep it up to date.
Deleting your account. You can delete your account at any time from Profile in the app, or by emailing [email protected]. We may keep records of past orders and invoices as required for accounting and tax purposes.
Suspension. We may suspend or close an account that violates these terms, is used to harm AMBIT or other users, or is inactive for an extended period.
4. Orders, pricing and product information
Orders are requests, not invoices. An order placed through the app is a request to purchase. It is not a binding contract or an invoice until AMBIT accepts it, completes a credit check where required, and issues an invoice. We may decline or cancel an order, for example when an item is unavailable, a price was shown in error, or an account is past due or over its credit limit.
Pricing. Prices shown in the app are subject to change without notice. Spray foam and fiberglass pricing is based on your customer pricing agreement with AMBIT. Applicable sales tax, freight and fees are added at invoicing unless a valid exemption certificate is on file.
Payment terms. Payment is due according to the credit terms on your AMBIT account or at the time of pickup or delivery if you do not have credit terms.
Product information. Technical data sheets, safety data sheets, evaluation reports, technical service bulletins and training materials are provided for information only. They do not replace the judgment of a qualified installer, the product’s published installation instructions, or the building code adopted where the work is performed. Always follow the applicable code and safety requirements.
Returns. Returns and credits are handled under AMBIT’s return policy and require AMBIT’s prior approval.
5. Acceptable use and intellectual property
Acceptable use. You agree not to:
- Use the website, app or texting program for anything unlawful
- Share your login with people outside your company or use another person’s account
- Try to access other customers’ accounts, pricing or data
- Copy, scrape, reverse engineer or interfere with the app or website
- Upload viruses or harmful code, or send spam through any AMBIT feature
AMBIT’s content. The AMBIT name and logo, the AMBI-SEAL, AMBI-TITE, AMBI-JACK and AMBI-ROOF product names, and the app, website, technical bulletins, training materials and other content are owned by AMBIT or its licensors. You may use them for your business with AMBIT and for installing AMBIT products. You may not resell, republish or rebrand them without written permission.
Your content. Information and files you upload (for example a job photo, a plan set for takeoff, or a tax exemption certificate) stay yours. You give AMBIT permission to store and use them to provide the service to you, such as reading a plan to produce a takeoff or reviewing a complaint report.
6. Disclaimers and limitation of liability
Service provided“as is.” The website, app and texting program are provided as is and as available. We work to keep them accurate and running, but we do not promise they will be error-free, uninterrupted, or that every text message will be delivered on time. Text delivery depends on your carrier and device.
Product warranties are separate. Nothing in these terms changes the written product warranty that comes with an AMBIT product. Product warranties are set out in AMBIT’s product warranty documents and technical data sheets.
Limitation of liability. To the fullest extent allowed by law, AMBIT is not liable for indirect, incidental, special or consequential damages (such as lost profits, lost jobs or project delays) arising from your use of the website, app or texting program. AMBIT’s total liability for any claim related to the website, app or texting program is limited to the amount you paid AMBIT for the order that gave rise to the claim, or $100, whichever is greater.
Some states’ laws differ. Some states do not allow certain limitations, so some of the above may not apply to you.
7. Changes to these terms and governing law
Changes. We may update these terms from time to time. The date at the top shows when they were last updated. If a change is significant, we will post a notice in the app or on the website. Continuing to use the website, app or texting program after a change means you accept the updated terms.
Governing law. These terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Oklahoma County, Oklahoma, and you agree to that venue.
Whole agreement. These terms, the Privacy Policy, and any written credit or pricing agreement between you and AMBIT make up the whole agreement for the website, app and texting program. If any part of these terms is found unenforceable, the rest still applies.
